Are Matt Lindsay's "Inappropriate" Videos A Crime?

Fort Wayne Defense Attorney Mark Paul Smith has practiced law for 30 years.  He says just because the Fort Wayne Diocese's s said they fired Matt Lindsay for video that the Diocese deemed inappropriate by their standards, does not mean it is criminal. He says we won't know until Matt Lindsay's computer is finished being looked through.  

 

He says in Indiana there are various laws to protect children.  Child exploitation laws can be applied if a person were to videotape or photograph children being sexually abused, having sex or engaging in sexually deviate behavior for pleasure.

 

The diocese says none of the video clips contained nudity but Smith says they do not have too.

 

Smith says since no criminal activity has been substantiated, and no one knows exactly what the videos contain, all citizens should be given the benefit of the doubt.

 

The Allen County Sheriff's department says they plan to wrap up their investigation of Lindsay by Monday.
