Lawsuit Says City of Ft. Wayne is Breaking Federal Law

Morgan is the owner of a home on Spatz Avenue which is leased to Kendra Ganaway. Ganaway says she invited a friend to stay at her house a couple of months ago for safety after her home had been broken into twice. She says she noticed suspicious behavior and then kicked the friend out.
A few weeks later Ganaway says the police showed up to search her house. Ganaway says she does not have any connection to drugs and did not know of any drug activity in her house. Morgan says Ganaway is a good tenant and he would like her to stay.
According to the lawsuit filed on June 12 of this year, Morgan will face a fine of 2500$ a day starting June 20th if he does not evict Ganaway. The suit cites Fort Wayne Municipal Code (section) 130.06 as being unconstitutional. Morgan says he believes the law is wrong and that he does not support drug activity in any way.
Ganaway is worried about what will happen if she is evicted, "If they do kick us out, I mean I have two little girls, we have nowhere else to go...it would be like we're homeless."
