He says it was an accident but results prove otherwise.

Two-months-ago, 27-year-old Brandon Black was watching his girlfriend's kids, an 11-month boy and 3-year-old girl. Court documents say Black went to sleep upstairs.

The kids were sleeping downstairs  in the bottom of a bunk beds.

Black said he woke up after hearing something fall down the stairs. He said he saw the 11-month-old unconscious at the bottom of the stairs. He told police he attempted CPR then called the child's grandma. The grandma arrived. She tried to revive the baby but was unsuccessful.

The 11-month-old, Kweli Dupri Thomas, died of blunt force head trauma.

The child had bruises on his stomach and chest. The infant's death is the twenty-fourth homicide in fort Wayne this year. Doctors say the injuries were not caused by a fall down the stairs.

The grandma told police that Black "would not help with cpr and kept going into the kitchen smoking a cigarette." She also said the baby was

"recovering from a broken arm and that he couldn't crawl very well. She believed that he couldn't walk up steps.

Black has been charged with battery and neglect of a dependent. FOX Fort Wayne looked up his criminal history and found a long rap sheet. Over the past 10-years Black's been charged with six counts of Robbery, Criminal Recklessness, two counts of, Battery, DUI, Sex with a Minor, Domestic Battery, and Possession of a Firearm by a Felon.

Black will be in court tomorrow morning for his initial hearing. Stay tuned to FOX Fort Wayne News, First At Ten.
