Appeals Court Overturns Boy's Adult Conviction

Murder convict Paul Gingerich had his adult conviction of conspiracy to commit murder overturned by the Indiana Court of Appeals.

Gingerich will now be tried as a juvenile back in Kosciusko County.

  

 Two years ago, then 12-year-old Gingerich pleaded guilty to helping murder his friend Colt Lundy's stepfather.   Gingerich and Lundy fled in a stolen car before their arrest in Illinois.

 

"I hate having to look at it again because it was horrible to look at the first time," said Bonnie Duncan, a Cromwell resident.   

 

"I did think it was behind us.  I didn't even realize there was a chance that they would be tried as juveniles," said Anita Carpenter, a Cromwell, IN resident.    

 

 

This is how the Cromwell residents reacted when finding out that 14 year old Paul Gingerich will be tried as a juvenile after the Indiana court of appeals overturned his adult conviction for conspiracy to commit murder. 

 

 

Anita Carpenter says today's ruling leaves her with a lot of unanswered questions.

 

 

"Occasionally I think about him and I wonder how he is, I wonder how old he is? How long is it before he gets out?  Will he live next to me when he gets out of jail?," said Carpenter. 

 

 

The judges in today's hearing found that Gingerich's lawyers did not have enough time to determine whether or not he was competent to stand trial in 2010. 

 

 

"He's not a kid.  He's never going to be a kid again even if they try him as a juvenile he's still never going to be a kid," said Carpenter.

 

 

Gingerich's lawyer tells WFFT that she's ecstatic about today's ruling and says justice was served.
